the family of a santa rosa teenager fatally shot is set to file a federal lawsuit against the county. the controversial shooting happened two weeks ago in santa rosa. 13-year-old andy lopez was shot and killed while carrying a toy gun that looked like an assault rifle. the civil rights lawsuit claims the sheriffs department encourages the use of deadly force even when there is no threat to public safety. the sheriffs office says this investigation is still in the early stages and calls the lawsuit premature. >>> a special city council session is being held tonight in clover dale. city leaders plan to discuss the crosswalk where two boys were hit on halloween night and a woman was hit and killed back in july. the boys as ages 12 and 13 were hit by a pickup truck. they suffered broken bones and a concussion but are recovering. the driver told police he did not see them in the street. police who live in the area says the intersection is too dark. >>> new information on the desperate search for a missing man in san francisco. police now hope a surveillance photo from mcdonalds restaurant

the shootng death of 13-year old andy lopez santa rosa police say a witness who was in the area heard sheriff deputy erick gelhaus order lopez twice to drop what he believed was an ak-47 rifle twice. and gelhaus himself said he knows he yelled at least once to lopez to drop the rifle. but gelhaus said he is unsure whether he identified himself as a sheriff's deputy. police also say lopez was wearing a hooded sweatshirt but his hood was down. lopez was also not wearing andy headphones or earbuds. also, police say a second deputy was with gelhaus in the car, but by the time the second deputy got out of the car, the subject was engaged and the threat was the teenager charged with saw trying to shoot a romantic rival and stealing the lamborghini of celebrity chef guy fieri was found guilit in marin county. 19 year old max wade was found guilty of one count of premeditated attempted murder for firing shots into a pick up truck in april of 2012. he was also found guilty of auto theft and posession of stolen property in connection with the 2011 theft of a lamborghini belonging to celebrity chef guy

-powered assault rifle. hundreds of students and others took to the streets of santa rosa earlier this week to protest the death of this popular eighth gradary. ma rowa teresa kumar is an msnbc contributor. this incident has caused a lot of outrage. there have been rallies, demonstrations, people holding up signs saying andy lopez did not have to die. also jail all racist killer cops. very strong language here. explain what we know about the facts of all this and how this case has now galvanized the community. >> good morning, thomas. thanks for doing this segment. this is something that's actually quite personal because i grew up in santa rosa in the community. sadly this is the third incident in less than eight years by a shooting of a teen victim by a police officer. and what we're seeing right now is the fact that you have young people, middle schoolers and high schoolers galvanizing, protesting in the streets, organizing. not your usual suspects, not the community leaders and church leaders but young people saying we need to have a better relationship with police officers because right
for a civil rights investigation. >> reporter: that's right, jessica. we're live in santa rosa, where people are gathering for a special day of the dead observance. among those being remembered, 13-year-old andy lopez who was shot and killed by a sheriffs deputy. i'll have an update on big legal developments in the case coming up. >>> and going beyond the politics of pot. coming up, we investigate a common practice by marijuana growers wreaking havoc on wildlife and on our environment. >>> the family of the 13-year-old boy shot and killed by a sheriffs deputy has filed legal claims against the sonoma county board of supervisors. the move is seen as a precursor to a lawsuit. at the same time, there's a new push to get the u.s. commission on civil rights involved to investigate claims that the boy's death points to a larger problem within the county. nbc bay area's monty francis joins us in santa rosa with the details tonight. >> reporter: raj, good evening. the family filed three claims against the county. one on behalf of the boy's mothers. another on behalf of the boy's father. a third on b
